How The Law Works
The framework comes from Poland's Gambling Act (Ustawa o grach hazardowych), first passed in 2009 and significantly amended in 2017.
The amendment, in force from April 2017, reserved online casino games and online slots for the state monopoly while opening online sports betting to privately licensed operators through a permit system run by the Ministry of Finance.
In other words, Poland treats online betting and online casino very differently: bookmakers can be licensed, online casinos cannot, other than the state one.
Enforcement And Blocked Sites
Poland backs the monopoly with active enforcement. The Ministry of Finance maintains a public Register of Domains used to offer gambling contrary to the Act, and internet providers are required to block listed sites while payment providers must refuse transactions to them.
The register is published online and updated regularly, and operators that ignore it face penalties, while players using illegal sites can also be sanctioned under the Act. That combination of domain blocking and payment blocking is the main reason offshore casinos struggle to reach Polish players legally.
Sports Betting Is Different
The licensed side of the market is online sports betting. A number of private bookmakers hold Ministry of Finance permits and operate legally, paying a turnover-based tax.
This split, a liberal betting market alongside a closed casino market, is unusual in Europe and has fuelled a long-running debate about whether Poland should open online casino to private licence holders too. Industry groups argue liberalisation would pull players away from unlicensed sites and raise more tax, while the government has so far kept the monopoly in place.
